Preamble

Due to the epidemiological situation in the country, which causes exceptional circumstances requiring the introduction of special measures and solutions, individual provisions of these regulations are/will depend on the currently applicable legal provisions and guidelines indicated on the website www.gov.pl. 

I. THE ORGANISER

The Organiser of the Running to the European Games is the Municipality of Kraków, the Sports Infrastructure Management Board of Kraków.

II. DATE AND PLACE

1.  Running to the European Games will be held on the 16th October, 2022 (Sunday) in Kraków.

2. The runners will start at 10:00 a.m. in front of TAURON Arena Kraków (7 Stanisława Lema Street). The starting gate will be closed after approximately 15 min from the start. It will not be possible to start to run after 10:15 a.m.

3. The finishing line will be located in TAURON Arena Kraków on 7 Stanisława Lema 7 Street.

4. The Competition Office:

a. will be located in Small Hall in TAURON Arena Kraków, 7 Stanisława Lema Street.

b. open on:

- the 14th October  (Friday) 2022 from 3:00 p.m. to 8:00 p.m.

- the 15th October (Saturday) 2022 from 10:00 a.m. to 8:00 p.m.

- the 16th October (Sunday) 2022 from 7:30 a.m. to 9:00 a.m.

Note! On the day of the run, the Competition Office only issues starting packages; it will be impossible to sign up and pay the entry fee.

III. ROUTE

1. The route of the run is 5 km long.
2. The route should be run within the regulation time, i.e. within 40 minutes.
3. A detailed description of the route will be published on the website www.cracoviapolmaraton.pl at a later date.
4. On the route, all kilometres will be marked.
5. WC cubicles and medical point will be located at the starting line and at the finish line.

IV. TERMS OF PARTICIPATION

1. The organizer sets the limits of starters: 1,000 competitors.

2. The list will be closed once 1,000 runners have registered. The organizer does not make entries to the reserve list.

3. The limit may change - in the event of changes in the guidelines and regulations regarding the organization of events in relation to the prevention, counteraction and combating of COVID-19.

4. The condition for the start is the entry of the competitor and payment of the entry fee.  If the entry fee is not paid, the registration is valid.

5. The Organizer reserves the right to organize the start in turns.

6. Competitors of at least 13 years of age as of 16 October, 2022 may participate in the Running to the European Games.

7. Time measurement and ordering will be made by an electronic time measurement system. During verification, each competitor will receive a chip embedded in the starting number, its proper fixing is a condition for starting in the run and classifying it in the final message of the competition.

8. The condition for classifying a competitor is to run along the approved route of the half-marathon and finish the run within the regulation time of 40 minutes.

Whoever stays on the route after this time, is responsible for it, in accordance with the applicable road traffic regulations and the Civil Code.

9. During the run, the participants should follow the instructions of the people responsible for safety, security services and people acting on behalf of the Organizer.

10. In the event of a privileged vehicle appearing on the route, the participants of the run are obliged to stop the run and allow the passage.

11. Runners who run the distance in an illegal manner will be disqualified.

12. The following are forbidden:

a. start without a bib number,

b. start of a competitor who is under the influence of alcohol or other intoxicants,

c. use of any vehicles on the route of the half marathon, except for the Organiser's vehicles,

d. start with animals,

e. start with baby carriages, with babies in wraps / carriers,

f. start with Nordic walking poles,

g. covering part of the route by means of transport, e.g. public transport,

h. shortening, changing the route,

i .start in wheelchairs for the disabled,

j. start and run without shoes.

13. The organizer does not provide participants with accident insurance. It is advisable to insure yourself against accidents on your own.

14. Handing over his starting number to another person will disqualify both competitors.

15. Competitors are required to follow the sanitary recommendations indicated by the sanitary services and the Organizer on the start date. Detailed instructions will be posted on the website www.cracoviapolmaraton.pl at a later date.

16. The race cannot be attended by people who on the day of the event:

a. have symptoms of infection, especially of the upper respiratory tract such as runny nose, cough;

b. have a temperature above 37,5C;

c. are in quarantine or isolation. 

V. APPLICATION PROCEDURE AND ENTRY FEE

1. Applications for participation in Running to the European Games  are accepted:

a. on the website of the race until October 6, 2022 or until the limit of participants is exhausted. Applications can be made via the application form on the website of the race - www.cracoviapolmaraton.pl.

b. at the Competition Office on 14-15 October 2022 if the limit of participants is not exhausted.

2. A properly completed application form and payment of the starting fee are considered valid applications.

3. By submitting the application for the race, the competitor declares that he is aware of the risks that may arise in connection with the start and that his health condition allows him to participate in this race.

4. Applications of underage competitors

a. The application of a underage competitor is made by the parent / legal guardian,

b. The application must provide all the required data and select the required consents,

c. The parent / legal guardian is obliged to provide their contact details. The organizer reserves the right to verify this data and contact the parent / legal guardian in order to verify the correctness of the application.

5. Verification of competitors, assigning starting numbers and collecting starting numbers and packages will take place at the Competition Office.

6. Verification and collection of the starting package is possible only in person at the Competition Office. It is not possible to verify and obtain the starting package on a date other than the opening date of the Competition Office specified in the regulations

7. The Organizer allows the situation of collecting the starter package on behalf of another person – by the Plenipotentiary

a. In order to enable the collection of the starter package by an authorized person, the competitor during registration should provide in the application form the data of the person he wants to authorize to receive the package,

b. the athlete has the option of entering the data of the Plenipotentiary until 13 October, 2022,

c. the package will be issued only to a person who has the QR code of the runner for whom he receives the package,

d. No data of the representative in the application prevent collection of the starter package.

8.  In the case of underage persons, the starting package may be collected by:

a. Parent / legal guardian whose data is provided in the application form,

b. underage competitor in person - only if the application is complete and contains all the required consents, including the explicit consent of the parent/legal guardian to collect the package and participate in the competition. In the absence of the required approvals or doubts as to the correctness of the application, the Organizer may refuse to issue the package to the underage person,

c. Plenipotentiary authorized by the parent/legal guardian - in accordance with the rules of receipt by the attorney specified in point V.7 of the regulations of the "Running to the European Games"and in these instructions for collecting the starter package in point III.

9. The organizer gives the possibility of purchasing a voucher - a gift for a runner has been introduced. Details on paying the starting fee for another. Details are available on the Organiser's website www.cracoviapolmaraton.pl.

10. Detailed instructions for collecting the starter package and verification are available on the Organiser's website www.cracoviapolmaraton.pl.

 11. Entry fee:

60 PLN - until October 6, 2022

100 PLN -  at the Competition Office - 14/10/2022 - 15/10/2022 if the limit of participants and the limit of premium packages are not exhausted.

a. The PayU system enables the payment of the entry fee in foreign currency by calculating the entry fee according to the foreign currency exchange rate on the date of payment.

b. It is possible to pay only in PLN  at the Competition Office.

12. Discounts:

50% discount for holders of the Krakow Family Card

a. valid Krakow Family Card and an identity document will be presented during the verification at the Competition Office.

b. Competitors who indicate the right to a discount during registration are required to present a valid Krakow 3+ Family Card at the Competition Office,

c. In the absence of relevant documents entitling to a discount, the competitor is obliged to make an additional payment to the amount of the starting fee applicable at the Competition Office– the difference to the amount of PLN 100

13. The following are exempt from the entry fee:

a. people with disabilities,

b. persons invited by the Organizer,

c. volunteers helping with the organization of the Runnning to the European Games.

14.  The players mentioned in points. V.13 point a-b sign up via the registration form, selecting the appropriate option to be exempt from the entry fee. Volunteers register only at the Competition Office.

15. Registrations of people with disabilities

a. The participants with disabilities are exempt from the entry fee,

b. During the verification competitors with disabilities are required to present documents confirming their eligibility for the discount,

c. In the absence of relevant documents entitling to a discount, the competitor is obliged to make an additional payment to the amount of the starting fee applicable at the Competition Office– the difference to the amount of PLN 100.

16.  The entry fee:

a. The payment of the starting fee is possible only via the PayU payment system until October 6, 2022 immediately after registration of participation or at the Competition Office at the rate applicable on the date of payment, if the starting limit is not exhausted.

b. Lack of payment upon registration will result in removal from the start list.

c. Payments made in a different way than specified in the regulations, ie by transfer to the Organiser's account, will not be accepted and will be returned to the account from which they were made.

d. The organizer does not allow the transfer of the fee and the starting package to another competitor.

e. The fee cannot be transferred to the next edition or another event.

f. The date of payment shall be the date of receipt of funds on the Organiser's bank account or the date of payment of the entry fee at the Competition Office.

g. The runner is obliged to check whether the transfer for the fee has been made, i.e. whether the amount of the fee has been debited from the account and has not been returned by PayU. The Organizer is not responsible for the lack of payment for reasons attributable to the Depositing Bank/PayU. The player making the payment has transaction numbers and as the client has the opportunity to explain the reason for the lack of entry fee.

h.  The starting fee paid to participate in the run is to, inter alia, cover the organizational costs of the event.

17. Every runner may resign from participation in the Race

a. the competitor who resigns is entitled to refund of the starting fee

b. the handling fee for the competitor who resigns is 20 PLN

c. The resignation is possible until 06/10/2022

d. In order to resign and obtain a refund, the competitor is obliged to:

- send a message to the Organizer: zapisy@zis.krakow.pl;

- the title of the message should include: "Resignation from participation in the ,,Runnning to the European Games";

- the message must contain a clear declaration of the competitor on his resignation from participation in the Runnning to the European Games;

- the message should also include: name and surname of the competitor, e-mail address, date of birth, home address and account number.

e. Only full applications will be considered

f. Only the competitor who is on the start list can resign personally. The message should be sent from the e-mail address from which the registration for the race was made,

g.  If the entry fee has been invoiced to another person than competitor, it is not possible to obtain a refund of the entry fee,

h.  In response to the sent e-mail with the resignation, the competitor will receive a message with a link to the payment of the handling fee specified in point V.17 point b.

i. The return of the entry fee will be made to the account number provided in the e-mail message within 20 working days from the date of sending the application,

j. The place on the start list released by the competitor's resignation from participation returns to the limit of free places,

18. Receipt of an invoice is possible only if this fact is indicated in the application form and indicates in it the data to which the invoice is to be issued and the e-mail address to which it will be sent by the Organizer. The invoice issued for a privat eperson is sent to the competitor's e-mail address.

19.  In the Running to the European Games the Fastest Team classification will be carried out. To participate in the classification, the following conditions must be met:

a. teams of minimum three and maximum six will be classified,

b. Each team must include at least:

- one underage person - who on October 16, 2022 is under 18 years of age;

- one adult,

c. During registration, each player from the team must indicate their willingness to participate in the Fastest Team classification, and in the "team" field each player must have the same team name entered. The name must be individual. Be careful of typos, Polish characters, spaces,

d. The final classification is determined by the sum of the three best times achieved by the players from the team, including the obligatory result of the minor,

e. The team with the best total time wins,

f. In the case of identical times, the order will be decided by the higher place of the last scoring competitor in the team.

VI. CLASSIFICATION

1. The following classifications will be held in the Running to the European Games

a. general of women and men

b. in the age categories of women and men:

K 13-15 M 13-15

K 16-17 M 16-17

K 18-29 M 18-29

K 30-39 M 30-39

K 40-49 M 40-49

K 50-59 M 50-59

K 60-69 M-60-69

K 70 and older M 70 and older

c. The fastest team

2.  The results of the general classification will be determined on the basis of gross times, while the results of other categories will be based on net times.

3. The organizer reserves the right to create additional classifications.

VII. AWARDS

1. Awards in the general classification of women and men:

1st place – 1 500 PLN

2nd place – 1 000 PLN

3rd place – 800 PLN

2. The organizer does not provide awards in age categories.

3. The fastest team will receive a non-cash prize.

4. The condition for receiving the prizes is to complete the run, and in the case of doping control - negative result.

5. Cash prizes will be paid to the account provided by the competitor after the Organizer obtains the results of the doping control (if it is carried out) and after receiving all the data necessary to make a bank transfer. Cash prizes obtained in other classifications, referred to point VI.3, will be paid to the account provided by the competitor in the statement indicating the exact data for the transfer.

6. In the case of cash prizes, the data for the transfer should be provided no later than 30 days from the announcement of the official results. After this date, the prize is forfeited to the Organizer.

7. If the total value of the award exceeds PLN 2,000, income tax will be deducted from the value of the award, in accordance with applicable regulations.

8. The official announcement of the results will take place 14 days after the end of the event.

VIII. ORGANIZER'S BENEFITS

1. Each competitor who finishes the race within the regular time limit will receive a commemorative medal.

2. Deposit

a. The deposit accepts personal belongings of runners packed in bags (we encourage you to bring your own bags for deposit) with a sticker with the starting number (bags and stickers will be issued during verification at the Competition Office)

b. The bags will be released from the deposit upon presentation of the bib numer

c. Losing the bib number by a runner releases the Organizer from liability for collecting the bag by another person upon presentation of the bib number.

d. It is forbidden to leave any valuable items or documents in the deposit.

e. The organizer is not responsible for participants’ belongings left outside the designated deposit.

f. Items left in the deposit must be picked up on 16 October, 2022 utnil 12:00 p.m.

3. Starting packages:

a. Each competitor will receive a starter package consisting of:

. sticker for the bag,

- cotton t-shirt,

- information / advertising materials.

 b. Competitors allowed to start will also receive their starting numbers and safety pins

c. Starting packets not collected at the Competition Office will not be sent or issued at a later date.

4. T-shirt:

a. The T-shirt is available in every starter package 

b. The starting packages include cotton T-shirts in various colors. It is not possible to choose the color of the t-shirt, both during registration and when picking up at the Competition Office. Colors are assigned randomly,

c. It is not possible to buy a T-shirt without buying a starter package and buying an additional, another T-shirt for the purchased package,

d. After paying the entry fee, it is not possible to change the size of the T-shirt indicated in the registration form,

e. The number of T-shirts in each size is limited. Lack of information about a certain size in the application form means that the limit of the given size is exhausted,

f. T-shirts at the Competition Office are issued on the basis of the size indicated in the registration form, without the possibility of changing the declared size during collection, until stocks of a given size are exhausted,

g. It is not possible to exchange the T-shirt after the end of the event in any case.

5. Starting numbers

a. The starting numbers are given at the Competition Office. It is not possible to book the selected number in advance.

b. During the race, competitors must have the starting numbers provided by the Organizer, pinned to the front of the starting T-shirt. Covering the bib number in whole or in part is unacceptable under penalty of disqualification.

c. The starting number is a document assigned to a specific competitor. In the event of loss of the bib number (loss), the competitor assigned to the given number is responsible for the start of another person on this number and it is the same as the situation described in point IV. 13.

d. The organizer does not issue duplicate starting numbers in any case.

e. The competitor is obliged to check if the bib number received by him is the same as the number on the sticker for the deposit

6. The organizer does not provide accommodation for competitors.

IX. FINANCING

Costs of organizing the Running to the European Games shall be borne by: the Municipality of Kraków, Sponsors and Partners.

X. PROTECTION OF PERSONAL DATA

1. The Organizer is the Data Administrator for the implementation of the event, verification of records, time measurement, payment processing, image processing, surveys, promotion and archiving of documentation related to the sports event.

2. The organizer has appointed Dorota Gross, the Data Protection Officer, who can be contacted at the following address: ul. Walerego Sławka 10, 30-633 Kraków, or the e-mail address: iodo@zis.krakow.pl

a. art. 6 sec. 1 lit. a) GDPR in connection with the consent given during the registration of the participant on the Registration Portal to the processing of the image in photo-video materials;

b. art. 6 sec. 1 lit. b) GDPR in connection with the conclusion of an agreement with the Municipality of Kraków - Sports Infrastructure Management Board of Kraków - acceptance of the Regulations, where the legal basis is the Act of 23 April 1964 - Civil Code;

c. art. 6 sec. 1 lit. c) GDPR in connection with the implementation of the related legal obligation with the verification and settlement of payments resulting from the provisions of the Act of March 11, 2004 on tax on goods and services;

d. art. 6 sec. 1 lit. f) GDPR in connection with the legitimate interest pursued by the Organizer to promote and shape a positive model of spending free time, promoting a healthy lifestyle, favoring the harmonious development of children and youth and increasing physical fitness - developing a passion for sports and recreation resulting from the Organiser's statute .

4. The personal data provided by you will be kept for the period necessary to achieve the purpose set out in point 3; after this time, they will be stored for the period of:

a. In the case of data processed on the basis of expressed consent, until its withdrawal, without affecting the lawfulness.

b. In the case of financial data up to 6 years, that is for the period specified in the law.

c. In the case of promotional activities, the data will be processed until the user submits an objection.

d. In the case of data collected for the purpose of archiving sports events and actions in connection with the Act of July 14, 1983. on the national archival resource and archives and the Ordinance of the Prime Minister of January 18, 2011 on office instructions, uniform material lists of files and instructions on the organization and scope of operation of company archives. If the archive category "A" is assigned, the data will be stored indefinitely.

5. You have the right to request ADO from:

a.access to your personal data;

b. sharing data;

c. rectification of data;

d. deletion of data;

e. limit the processing of your personal data.

6. You have the right to lodge a complaint with the supervisory body, which is the President of the Personal Data Protection Office with its seat at ul. Stawki 2, 00 –193 Warszawa, if, in your opinion, the processing of your personal data is unlawful.

7. The provision of your personal data by you is voluntary, but necessary to achieve the purpose specified in point 3. Failure to provide personal data specified in paragraph 3 will result in the inability to conclude the contract with you, i.e. take part in the event.

8. The recipients of the personal data provided by you will be entities to which PDC has entrusted the processing of personal data on the basis of separate processing entrustment agreements - e.g. in connection with the implementation of hosting services, e-mail, promotion, publication or archiving of documents; Your data may be made available to other public administration authorities, control authorities, judicial authorities and courts, at their justified request (in accordance with applicable regulations).

9. The recipient and a separate data administrator in the field of keeping records of participants on the basis of expressed consent is Datasport Marek Zieliński, ul. Okręna 22, 58-310 Szczawno Zdrój NIP: 886-002-17-67, cooperating with the Organizer on the basis of a cooperation agreement in this area. REGULATIONS of subscriptions and the Privacy Policy are available on the Subscriptions Portal.

10. Your personal data will not be transferred to third countries and international organizations.

11. The personal data provided by you will not be processed automatically and will not be profiled.

XI. FINAL PROVISIONS

1. Participants in the Running to the European Games are bound by the regulations of the Polish Athletics Association and these regulations.

2. Based on Art. 38 point 12 of the Act on consumer rights, participants are not entitled to withdraw from the contract for the provision of services related to entertainment, sports or cultural events, if the contract indicates the day or period of service provision.

3. The Organizer reserves the right to conduct doping control during Running to the European Games.

4.  The organizer informs that on May 16, 2022, an epidemic threat was introduced in the territory of the Republic of Poland in connection with SARS - CoV - 2 infections. Taking into account the dynamics of the epidemic, the changing situation may result in the necessity to introduce generally applicable restrictions aimed at limiting virus transmission. In connection with the above, the Organizer reserves the right to amend these Regulations in the event of introducing restrictions and the need to adapt the provisions of the Regulations to them.

5. The organizer reserves the right to cancel or change the date of the Running to the European Games in the event of:

a. force majeure events that may have an impact on the course of the event.

b. an increase in infections in the territory of the Republic of Poland related to the spread of the Sars-CoV-2 virus, which could pose a threat to the life and health of competitors and people participating in the organization of the Running to the European Games.

c. introducing generally applicable restrictions (in particular regarding the limits of competitors), which would make it impossible or significantly difficult to conduct the Running to the European Games.

6. Force majeure, within the meaning of these regulations, are any unforeseeable situations or events, of an exceptional nature, beyond the control of the Organizer, preventing the fulfillment of any of the obligations provided for in these regulations, not resulting from an error or negligence of the Organizer and remaining insurmountable, despite all due diligence. , in particular: natural disasters such as flood, hurricane, extraordinary storms, tornadoes, earthquakes, extremely intense and prolonged rainstorms or extraordinary and external events that could not be prevented (such as: war, restrictions of martial law , uprising, revolution, riots, terrorist attack), epidemic threats, epidemic threats, epidemics and epidemic states, as well as new legal acts or decisions of administrative authorities preventing the Organizer from fulfilling its obligations. Neither the Organizer nor the competitors are responsible for non-performance or improper performance of the provisions of these regulations due to force majeure.

7. The organizer reserves the right to change irrelevant provisions of these Regulations.

8. If significant changes are necessary, the Organizer will notify the Participants / Users about the change in the Regulations via e-mail. The Participant / User who does not accept the introduced significant changes to the Regulations should notify the Organizer within 14 days of receiving information about the change in the Regulations. Sending such a notification results in the removal of the Participant from the race - in such a case, the paid entry fee will be refunded.

9. Written protests regarding the course of the Running to the European Games and its results are received by the Main Judge of the Competition by 11:00 a.m. on the day of the run. Protests submitted after this date will not be examined.

10. Complaints regarding matters related to the participation and organization of the Running to the European Games may be submitted in writing to the Organiser's address or by e-mail to the following address: zapisy@zis.krakow.pl no later than 7 days after the end of the event.

11. The organizer reserves the right to change the date and route of the race.

12. Application for participation in the race expressed by sending the application in accordance with point V or submitting it to the Competition Office is tantamount to accepting the rules of the race.

13. The Regulations are available for inspection at the Organiser's office and on the website www.cracoviapolmaraton.pl.
